Acceptable Use Policy

1. The Customer shall not:

a. Remove, modify or obscure any copyright, trademark or other proprietary rights notices that may be contained in any of the Software provided for the Customer’s use by Blue Sky;
b. Reverse engineer, decompile or disassemble any of the Software provided by Blue Sky;

2. The Microsoft and Linux software provided by Blue Sky is not fault-tolerant and therefore is not intended for use in any situation where failure or fault of any kind in the Software could lead to death or serious personal injury or to severe physical or environmental damage (“High Risk Use”).

3. The Customer is not licensed to use the Software in or in conjunction with High Risk Use. High Risk Use includes use for example in the following:

a. Aircraft or other methods of human mass transportation;
b. Nuclear or chemical facilities;
c. Class 11 medical devices as described in the United States of America’s Federal Food, Drug and Cosmetic Act.

4. The Customer shall use its reasonable endeavours to prevent any unauthorised access to, or use of, the Data Storage and notify Blue Sky promptly of any such unauthorised access or use;

5. The Customer may not send or transmit any unsolicited or unauthorised advertising or promotional material (also known as SPAM);

6. The Customer shall not access, store, distribute or transmit any Viruses, or any material during the course of its use of the Services that:

a. is unlawful, harmful, threatening, defamatory, obscene, infringing, harassing or racially or ethnically offensive;
b. facilitates illegal activity;
c. depicts sexually explicit images;
d. promotes unlawful violence;
e. is discriminatory based on race, gender, colour, religious belief, sexual orientation, disability; or
f. that is otherwise illegal or causes damage or injury to any person or property; and

Blue Sky reserves the right without liability or prejudice to its other rights to disable the Customer’s services where those have been identified that they are in breach of the provisions of this Policy.

Changes To This Acceptable Use Policy

If we decide to change our Acceptable Use Policy, we will post those changes to this acceptable use policy statement, the home page, and other places we deem appropriate. We reserve the right to modify this Acceptable Use Policy at any time, so please review it frequently. If we make material changes to this policy, we will notify you here, by email, or by means of a notice on our home page.
